This short-term rental contract constitutes the “Agreement” between the “Visitor” and Mont Tremblant Chalet Rentals Inc (herein referred to as “Tremblant Living” or “TL”) the manager, to rent the Property described above, including furniture (the “property”) according to the ”Rental Period”, and “Rules and Regulations” set out below. The Parties agree as follows:
1. NATURE OF AGREEMENT
The Visitor is renting the house as a vacation rental for a short-term period. The Property is a privately-owned residence and TL is not the owner and only acts as manager or rental agent.
The Property owner and Tremblant Living shall not be responsible for providing any additional furnishings or supplies not listed under our Property Details and What’s Included sections of our website. This Agreement allows Visitor limited occupancy granted by TL and Property owner. Visitor is not a tenant under any applicable legislation.

4. AGREEMENT TO RULES AND REGULATIONS
Visitor agrees personally and on behalf of his/her guests to abide by terms in this Agreement, including the rules included on the Rules and regulations included on Exhibit A, and takes full responsibility for the actions and omissions of his/her guests. Failure to respect the terms and rules by the Visitor or a visitor’s guest constitutes a breach of the agreement. In a case like that, TL or the owner have the right to access the property.
5. DAMAGES TO PROPERTY
5.1 ACCIDENTAL DAMAGE WAIVER FEE
To be applicable, this option needs to be selected at the time of booking the property. The Accidental Damage Waiver (DWF) is a nominal, non-refundable fee that alleviates Visitor responsibility for accidental damages to the real or personal property of the owner of up to a total of $1,200. Damage more than $1,200 and caused by the visitor or his/her guests or pets in violation with the terms on section 5 a) b), and deemed negligent or intentional by TL and/or qualified contractors will be Visitor’s sole responsibility.
Any of the cost related to the damages may be debited from the credit card submitted by Visitor.

We require a credit card guarantee for your damage deposit. No credit card debit will occur if no costs/damages are incurred as per Sections 5, 5.1 and 5.2 stated above.
6. REFUND POLICY
Visitor acknowledges, understands, and agrees that:
The property owner has subscribed an insurance policy to protect his/her property and contents. TL recommends that Visitor take out their own personal insurance to cover Visitor’s personal property loss during the Property Rental Period, as well as personal liability insurance. This is suggested only as a recommendation, but it is not mandatory to secure reservation.
9. ACCESS BY TREMBLANT LIVING OR PROPERTY OWNER
TL or Property owner may re-enter premises at all reasonable times (by appointment and at the convenience of Visitor) for the purpose of effecting necessary repairs or maintenance.
The Visitor agrees to take all reasonable steps to ensure that all invitees adhere to the posted rules and regulations of the co-owners’ association (referred to herein as “COA”) governing the use of roads as well as any neighborhood common areas, in addition to the rules and guidelines of the present agreement:
A. QUIET ENJOYMENT AND PARTIES
TL maintains an atmosphere for the quiet enjoyment of Visitors. We rent to family groups and responsible adults only; absolutely NO house parties are allowed. Visitors shall be sufficiently quiet and peaceful, so as not to disturb neighbours and other residents of the area.
The number parking spaces is limited to the number of cars as stated clearly Homeaway or TL’s website. Additional overflow can be found at the entrance of the pedestrian village (parking P1, P2, or P3). It is strictly FORBIDEN to exceed the number of cars allowed at the property. If that happens cars will be towed without notice at the Visitor’s expense.
C. NOISE POLICY
Noise levels must be reasonable at all times as this is a quiet neighbourhood. We require that you adhere to a ”low exterior noise policy” after 9:30PM. As outlined in greater detail below, Tremblant Living has the right to terminate this Agreement and ask the disruptive Visitor to vacate the premises.
D. NO SMOKING
Smoking inside the property is not allowed. Visitors will be charged $500 to de-ozone the Property should this be detected and necessary.
E. MAXIMUM OCCUPANCY
That Visitor and invitees may not exceed the maximum capacity stated on Homeaway or TL’s website at any time, unless approved in writing by Tremblant Living. If the maximum capacity of the unit is exceeded, the Visitor may be subject to being removed from the property without refund.
F. AGE OF VISITOR
That Visitor and invitees must be at least 30 years of age. Visitors younger than 30 are acceptable as long as they are supervised by someone 30+ in age. Exceptions to this rule may be negotiated at TL’s discretion. If a group is mainly composed by individuals less than 30 years of age, TL reserves the right to ask for a detailed list of each visitor including their full name, address and a copy of their driving license. This information must be provided at the same time as the rental agreement.
No pets are permitted in the Property unless specified by Tremblant Living in writing. If a pet is allowed by Tremblant Living – the following rules must be respected by the pet owner.
By signing this agreement, the Visitor’s declare that the information given on the pet is accurate and that they will take full responsibility for any damages caused by the pet during their stay. A pet fee may be asked by TL and included in this agreement.
H. ILLEGAL DRUGS AND HAZARDOUS MATERIALS:
Visitors shall not use or permit to be brought into the property any illegal substances or articles deemed hazardous to life, or property.
I. USAGE OF COMMON AREAS
Occupancy and use of premises and common areas shall not disturb or to offend neighbors. Visitor may not hang towels or garments from windows and balconies. ONLY use appliances as intended.
J. HOT TUB AND SPAS
DO NOT STAND ON THE HOT TUB/SPA COVERS. Covers are for insulation purposes and are not designed to support a person. They may break and Visitor may be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay warm. Please shower before use and remove all make-up, body creams and perfumes which affect the water quality. Intense/extra cleaning to be performed either during or upon check-out will be subject to additional fees.
TL will provide firewood for reservations from Octobe 1st through April 15th for reasonable use and enjoyment of Visitors. However, fireplaces and/or fire pit are not to be left unattended. Note that TL maintains a large firewood stockpile equivalent to several weeks/ Visitor’s worth of wood so Visitor and group are expected to use it moderately and be mindful of future Visitors.
L. PERSONAL PROPERTY OF OWNERS
Locked closets are reserved for storage of the property owner’s personal items and are thus not available for Visitor usage under of this Agreement.
The Property may not be sublet and this Agreement may not be transferred without prior written consent of TL.
N. NON RESPECT OF RULES
TL must be satisfied that all of the terms and conditions contained in this Agreement will be adhered to by the Visitor and invitees, failing which TL and Property owner reserve the right, at the Visitors’ expense, to call a security firm (of TL’s choice) to verify if rules are respected, to impose the respect of rules or ultimately to have the Visitor and invitees removed from the Property if necessary. The costs associated with this security measure shall be borne by the Visitor from the credit card guarantee and any shortfall covered following a written request (transmitted by mail, by fax, or by e-mail) to the Visitor. In such situations, Visitor will forfeit all funds paid under this Agreement.
O. PHONE CALLS
Use of the phone line is free. TL reserves the right to recover costs for any long-distance telephone calls made by Visitor from the Property’s land-based telephone during the Rental Period.
P. MAINTENANCE OF PROPERTY
TL diligently maintains the Property but it is also the responsibility of the Visitor to exercise caution and take reasonable care with respect to the interior/exterior of the Property. This also applies to common areas owned by the unit’s co-owner association (if applicable). These spaces include, but are not limited to, walking/ski-out paths and parking area. TL advises Visitor to exercise caution in slippery conditions especially when outside in winter and particularly around the hot tub areas where water/ice can form.
Q. MISSING ITEMS AT CHECK-OUT INSPECTION
An inspection will be done following Visitor departure to ensure all items, furniture and appliances are not missing. Visitor will be charged a fee in case an item is taken from the property. For the properties including an Apple TV entertainment, Visitor will be charged $300 if this item is missing. This charge is not covered by the Damage Waiver Fee; it is the sole responsibility of Visitor to respect owner’s and TL’s belongings.
This Agreement shall be interpreted and applied according to the laws of the Province of Quebec.
By signing this Agreement, the Visitor(s) declare that all information provided on the reason of the group stay’s and intention for renting the property have been fully disclosed, are accurate and that all Visitors will be informed of and will follow each of the clauses of this rental agreement.
